Welcome to Scholars Gig ("Platform", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website, services, and any related applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Eligibility
To use Scholars Gig, you must be at least 16 years old or the legal age of majority in your jurisdiction, and capable of entering into legally binding contracts. By using the platform, you represent and warrant that you meet these requirements.
2. User Accounts
You may be required to create an account to access certain Services.
You must provide accurate and complete information.
You are responsible for maintaining the confidentiality of your login credentials.
You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts found to be in violation of these Terms.
3. Platform Purpose and Limitations
Scholars Gig is a marketplace platform that connects clients (students, researchers, institutions) with academic freelancers (tutors, editors, consultants). We do not guarantee outcomes or grades, nor do we support or endorse academic dishonesty.
Users may not use the platform for:
Submitting purchased work as their own (e.g., ghostwriting for school assignments)
Violating institutional honor codes or academic policies
Spamming, harassment, or illegal activity
4. User Responsibilities
You agree to:
Comply with all applicable laws and academic integrity rules
Communicate respectfully and professionally
Only post content and assignments that you have the right to use
Not request or deliver content that violates copyright or is plagiarized
We reserve the right to remove content or suspend users who violate these terms.
5. Payment Terms
Scholars Gig uses a secure third-party payment processor (e.g., Stripe, PayPal).
Clients agree to pay all charges associated with services requested.
Freelancers will receive payments after successful project delivery, minus platform fees.
Refunds and dispute resolution will be handled on a case-by-case basis, subject to our Refund Policy.
Platform Fees: We charge a [insert %] commission on completed transactions. This is automatically deducted before funds are released to freelancers.
6. Intellectual Property
All content created by freelancers for clients belongs to the client upon final payment, unless otherwise agreed in writing.

Users may not copy or distribute any content or intellectual property found on the site without explicit permission.
7. Prohibited Conduct
You agree not to:
Use Scholars Gig for cheating, plagiarism, or academic fraud
Misrepresent yourself or your qualifications
Harass or abuse others
Circumvent the platform to avoid service fees
Upload malware or conduct cyberattacks
Violation may result in account termination and legal action.
8. Disclaimer of Warranties
Scholars Gig provides its platform "as is" and "as available." We make no guarantees regarding the:
Quality, accuracy, or legality of work delivered by freelancers
Suitability of users for your specific needs
Availability or uptime of the platform
We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, Scholars Gig shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:
Loss of data
Academic penalties
Financial loss or missed opportunities
Our total liability for any claim arising from use of the platform will not exceed the total fees paid by you to us in the past 6 months.
10. Dispute Resolution
In the event of a dispute between users, we encourage amicable resolution through direct communication.
If necessary, Scholars Gig will intervene as a neutral mediator based on our Dispute Resolution Guidelines.
Governing Law: These Terms are governed by the laws of [Insert Jurisdiction].

11. Termination

13. Changes to These Terms

14. Refund and Return
A. General Refund Policy
i. Refunds may be issued under the following circumstances:
ii. The freelancer fails to deliver the agreed-upon work by the deadline.
iii. The delivered work does not meet the agreed specifications or is significantly below academic or professional standards.
iv. There is clear evidence of plagiarism or unauthorized content reuse.
v. The freelancer cancels or withdraws from the task after accepting the order and payment.
vi. Requests must be made within 7 days of order completion. After this period, all payments are considered final.
B. Partial Refunds
i. Partial refunds may be considered when:
ii. A portion of the work is delivered but is incomplete or unsatisfactory.
iii. The client decides to cancel the project after work has already begun, but before completion.
The refund amount will be assessed based on:
Work completed
Time invested by the freelancer
Any agreement between both parties
C. Non-Refundable Scenarios
Refunds will not be granted if:
i. The client changes their mind after delivery and no quality issues are found.
ii. The work is rejected due to external academic or institutional reasons unrelated to the service provided.
iii. The client fails to provide clear instructions or materials needed to complete the task.
iv. The client has already downloaded, used, or submitted the delivered work.
v. The refund request is made outside the 7-day refund window.
15. Cancellation Policy
A. Order Cancellations by Clients
i. Clients may request to cancel an order within 24 hours of placing it, if no work has started.
ii. After work begins, cancellation requests must be submitted with a valid reason (e.g. missed deadline, quality concerns) and will be reviewed by the ScholarsGig Resolution Team.
iii. If the freelancer has already delivered the order, clients must request a revision before disputing.
iv. Repeated or abusive cancellation requests may lead to account restrictions.
B. Order Cancellations by Freelancers
i. Freelancers may cancel an order only in exceptional cases (e.g. incomplete brief, unresponsive client) and must provide clear justification.
ii. Frequent cancellations by freelancers may affect their profile and ratings.
C. Late Delivery
i. Orders not delivered within the agreed timeframe are eligible for automatic cancellation after 24 hours, unless an extension is mutually agreed upon.
ii. Clients may request cancellation if the freelancer has not communicated within the delivery window.
D. Refunds in the case of cancellation.
i. Approved cancellations will result in a credit refund to the client’s ScholarsGig wallet.
ii. Monetary refunds to original payment methods are possible only in rare, escalated cases at ScholarsGig’s discretion.
16. Dispute Resolution
Disputes must be submitted within 5 days of order delivery.
The ScholarsGig Resolution Team will mediate based on communication history, deliverables, and platform terms.
